1. Agreement to Terms

By accessing or using architect.estate (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

The Service is owned and operated by Ehab Allababidi ("we," "us," or "our"). These Terms apply to all users, including visitors, registered users, and paid subscribers.

2. Age Requirements (COPPA Compliance)

You must be at least 13 years old to create an account and use this Service.

For users aged 13-17: By registering, you represent that you have obtained parental or guardian consent to use this Service. We may request proof of parental consent at any time.

For parents/guardians: If you become aware that your child has provided personal information without your consent, please contact us at defcon5ready@gmail.com and we will delete it promptly.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Subscription Plans & Billing

4.1 Free Plan

Free users receive access to downloadable guides and basic dashboard features. No payment required.

4.2 Paid Plans

Paid subscriptions (Starter, Pro, Elite, Family) are billed monthly or annually based on your selection.

• Billing Cycle: Monthly plans renew on the same day each month. Annual plans renew yearly.
• Payment Methods: We accept credit/debit cards via Stripe.
• Auto-Renewal: Subscriptions automatically renew unless cancelled before the next billing date.
• Price Changes: We will notify you 30 days before any price increases.
• Failed Payments: If payment fails, your access to paid features will be suspended after 7 days.

4.3 Cancellation

You may cancel your subscription at any time from your dashboard settings. Upon cancellation:

• You retain access until the end of your current billing period
• No partial refunds for unused time (unless within 60-day guarantee period)
• Downloaded guides remain yours to keep
• Access to Discord, videos, and live Q&A ends at period close

5. 60-Day Money-Back Guarantee

We offer a 60-day money-back guarantee for first-time subscribers to paid plans.

Eligibility:

• Valid for first 60 days after initial purchase only
• Does not apply to renewals or repeat purchases
• Available for Starter, Pro, Elite, and Family plans

Process:

Email defcon5ready@gmail.com with "Refund Request" in subject line. Include your account email and reason for refund. Refunds processed within 5-7 business days to original payment method.

Abuse Prevention:

We reserve the right to deny refunds to users who abuse this policy (e.g., multiple sign-ups, account sharing).

6. Intellectual Property

All content on this Service—including guides, videos, templates, graphics, and software—is owned by Ehab Allababidi and protected by U.S. copyright, trademark, and intellectual property laws.

License Grant:

Paid subscribers receive a limited, non-exclusive, non-transferable license to:

• Access and download materials for personal use
• Use templates and guides for your own business ventures
• Follow tutorials to set up systems for personal or client use

Prohibited Uses:

You may NOT:

• Redistribute, resell, or share guides/videos publicly
• Create derivative courses or competing products using our materials
• Share your login credentials with non-subscribers
• Record, screenshot, or copy videos for redistribution

7. User Conduct

You agree NOT to:

• Use the Service for any illegal purpose
• Harass, threaten, or abuse other users in Discord or community spaces
• Post spam, malware, or inappropriate content
• Impersonate others or provide false information
• Attempt to hack, reverse engineer, or exploit the Service
• Share copyrighted content without permission

Violation may result in immediate account suspension or termination without refund.

8. Educational Purpose & No Guarantees

This Service provides educational content only. We do not guarantee:

• Specific income levels or business success
• That you will acquire clients or make money
• That technical setups will work in all environments
• That you will pass any certifications or assessments

Income examples (e.g., "$2,240 average first-year income") are based on case studies and surveys but are not typical or guaranteed results. Your success depends on effort, market conditions, and skill development.

You are solely responsible for: Business licensing, taxes, liability insurance, client contracts, and compliance with local laws.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Ehab Allababidi, architect.estate, and its affiliates SHALL NOT BE LIABLE for:

• Lost profits, revenue, or business opportunities
• Data loss or corruption
• Indirect, incidental, or consequential damages
• Damages exceeding the amount you paid in the past 12 months

This limitation applies even if we were advised of the possibility of such damages.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Third-Party Services

The Service integrates with third-party platforms:

• Clerk: Authentication (subject to Clerk's Terms)
• Stripe: Payment processing (subject to Stripe's Terms)
• Discord: Community chat (subject to Discord's Terms)
• Vercel: Hosting (subject to Vercel's Terms)

We are not responsible for third-party services' availability, security, or terms.

12. Privacy & Data Collection

Your use of the Service is also governed by our Privacy Policy.

By using the Service, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page.

Continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with changes, you must stop using the Service and cancel your subscription.

14. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent activity or chargebacks
• Abusive behavior toward staff or community members
• Any reason at our sole discretion

Upon termination, your access ceases immediately. No refunds will be issued except as required by law.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

Arbitration Agreement:

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration under the American Arbitration Association (AAA) rules, rather than in court.

Exception: Small claims court disputes (under $10,000) may be filed in Cook County, Illinois.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.
